HON'BLE MR. JUSTICE ASHOK KUMAR GAUR Order 25/11/2019 The present batch of petitions have been filed by the petitioners-institutions for seeking a direction against the University to grant provisional extension of affiliation for the Academic Year 2019-20 to the petitioners-institutions and further seeking direction for inclusion of name of petitioners-institutions for the purpose of counselling for allotment of students for the Academic Year 2019 in B.Ed. Courses.
Learned counsel for the petitioners-institutions Mr.Mahendra Shandilya submitted that this Court on 12.7.2019 had passed elaborate direction whereby the University was (D.B. SAW/1151/2019 has been filed in this matter. Please refer the same for further orders) (Downloaded on 07/06/2021 at 04:27:32 AM) (3 of 4) [CW-4567/2019] permitted to consider the eligibility of the petitioners-institutions to have the provisional affiliation by specifying the requirement of NOC from the State Government and recognition from NCTE.
Learned counsel submitted that in pursuance of the order passed by this Court on 12.7.2019, the respondent-University issued an order dated 31.7.2019 and after inspection report by the Inspection Team and recommendation of Board of Inspection (BOI), the petitioners-institutions have been granted fresh provisional affiliations for the Session 2019-20.
Learned counsel for the respondents-University Dr.Y.C. Sharma does not dispute the issuance of order dated 31.7.2019. The present writ petitions do not require any adjudication on merits as the provisional affiliation has been granted to the petitioners-institutions for the Academic Year 2019-20 vide order dated 31.7.2019.
Learned counsel for the petitioners-institutions submitted that there is an urgency in the present matters for the purpose of declaring result of the students as the students have to participate in the selection process for various posts and authorities have fixed the last date for such participation.
This Court finds that the interim direction was given to allow the students to appear in examination for the Academic Year 2017-18 and 2018-19, and as such, their result is also required to be declared by the University.
This Court also finds that since the students have already appeared in the examination, the respondent-University/ Authorities will take expeditious measures to declare result of such students, and endeavour should be made to declare the result (D.B. SAW/1151/2019 has been filed in this matter. Accordingly, the present petitions are disposed of with a direction to the respondent-University to declare the result of the students, within a period of four days after submission of a certified copy of this order, who have been permitted by this Court to appear in the B.Ed. Examination for the Academic Year 2017-18 and 2018-19.
A copy of this order be separately placed in each connected petition.
