TARAPADA GANGOPADHYAY MEMBER For the Petitioner: Ms. Kajal Bhattacharyya, Advocate For the Respondent: Mr. Avijit Bhuina, Advocate Dated : 25 Sep 2017 Final Order / Judgement HON'BLE JUSTICE ISHAN CHANDRA DAS, PRESIDENT Questioning the propriety of the order no. 6 dated 21-02-2017 passed by Ld. DCDRF, Kolkata (1), North in CC/119/2016, the present revisional application has been preferred by the OP of the said complaint case. In the order impugned Ld. Forum concerned while passing the order impugned expressed its inability to pass any effective order for want of quorum on the date (27-02-2017) and directed to keep the written version with the record without accepting the same on vacating the order for exparte hearing of the complaint case. Since there was no quorum on the date (27-02-2017) he was not in a position to consider the prayer of the petitioner/i.e. the OP herein. From a perusal of the order impugned, we are of the view that Ld. Forum concerned did not commit any mistake in passing the order and it is held in the light of the provisions of section 17 (1) (b) of the Consumer Protection Act. Hence we dismiss the revisional application being devoid of any merit. No costs. [HON'BLE MR. JUSTICE ISHAN CHANDRA DAS] PRESIDENT [HON'BLE MR. TARAPADA GANGOPADHYAY] MEMBER
