                     PRAYER: Writ Petition filed under Article 226 of the Constitution of

                     India, praying this Court to issue a Writ of Certiorarified Mandamus, to

                     call for the records relating to the impugned order passed by the 2nd

                     respondent,      on 20.06.2023 and quash the same as illegal and

                     consequently direct the respondents to give grant permission and

                     adequate police protection and also providing sound service permission

                     during the 7th Year Lighting Kabadi Tournament, schedule to be held on

                     08.07.2023 at Night 10.00 p.m. to 09.07.2023 till morning 10.00 a.m.

                                                          ORDER

This writ petition has been filed challenging the impugned order passed by the 2nd respondent, on 20.06.2023 and consequently, seeking direction to the respondents to give grant permission and adequate police protection and also providing sound service permission during the 7th Year Lighting Kabadi Tournament, schedule to be held on 08.07.2023 at Night 10.00 p.m. to 09.07.2023 till morning 10.00 a.m. situated at Vayalnambikulam, Keelauppurani, Cheramahadevi Taluk, Tirunelveli District.

2.Mr.B.Nambiselvan, learned Additional Public Prosecutor, takes notice for the respondents.

3.The learned counsel for the petitioner would submit that the representation that was made by the petitioner, on 07.06.2023, seeking permission to conduct day and night Kabadi Competition. The same was 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.15320 of 2023 rejected by the second respondent stating that law and order problem will be arisen in that locality. Challenging the above said rejection order, this writ petition has been filed.

4.The learned Additional Public Prosecutor appearing for the respondents would submit that they have been seeking permission to conduct the tournament for two days i.e., 08.07.2023 and 09.07.2023 and the time sought for conducting the tournament is in the day and night time also. He would further submit that they may be permitted to conduct the tournament on day time.

5.The learned counsel for the petitioner would submit that the petitioner is ready to conduct the Kabadi Tournament during the day time.

6.In view of the submissions made on either side, the writ petitioner is directed to file fresh representation by mentioning the date, time and place to the second respondent, within a period of one week from the date of receipt of a copy of this order. On receipt of such representation, the second respondent is hereby directed to consider the 3/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.15320 of 2023 same and pass orders immediately, imposing necessary conditions, which is reasonable and depending upon the ground situation, by following the order passed by the Hon'ble Division Bench of this Court in the case of C.Sathasivam Vs. The Superintendent of Police, Trichy District and another, in W.P.(MD).No.12535 of 2023, dated 24.05.2023 and in the light of the circular of the Director General of Police, Tamil Nadu, Chennai in Rc.007301/Genl.I (1)/2019 dated 09.04.2019.

7.With the above said directions, this writ petition stands disposed of.
