1. Heard learned counsel for the applicants and learned A.G.A. for the State.
2. The present 482 Cr.P.C. application has been filed to quash the entire proceedings of Complaint Case No. 18/2014 (Sudhakar @ Gama Yadav Versus Indrasan and others), arising out of Case Crime No. 205A/2013, under Sections 147, 148, 149, 304, 323, 504, 506 I.P.C., Police Station- Jhangha, District- Gorakhpur, pending before Additional Chief Judicial Magistrate-I, Gorakhpur.
3. The contention of learned counsel for the applicants is that no offence against the applicants is disclosed and the present prosecution has been instituted with a mala fide intention for the purpose of causing harassment.
4. Per contra, learned AGA submitted that from perusal of impugned FIR and on the basis of the allegations made therein the impugned proceeding is not liable to be quashed.
5. However, considering the nature of the allegations made in the F. I. R. and submissions made by learned counsel for the applicants, it is directed that in case the applicants, namely, Indrasan, Jagarnath, Raj Kewal, Vijay @ Vikki, Jairam, Santosh and Ashok, appear before the court concerned within three weeks from today and apply for bail, the same shall be heard and disposed of expeditiously.
6. For a period of three weeks from today, no coercive measure shall be taken against the applicants, namely, Indrasan, Jagarnath, Raj Kewal, Vijay @ Vikki, Jairam, Santosh and Ashok, in the aforesaid case.
7. With the above directions, this application is disposed of finally.
