PRAYER: Writ Petition is filed under Article 226 of Constitution of
India praying to issue a Writ of Mandamus directing the respondents to
include the petitioner in the list of NRI eligible candidates for admission
to petitioner in the list of NRI eligible candidates for admission to the
Puducherry State MBBS NEET – UG Counseling 2025-2026 and permit
her to participate in the Counseling Rounds of Tamil Nadu MBBS NEET
– UG 2025-2026 under the NRI Quota for admission to the MBBS
Course 2025-2026.

ORDER
This writ petition has been filed for direction to the respondents to include the petitioner's name in the list of NRI eligible candidates for admission to the Puducherry State MBBS NEET-UG counselling 2025-2026 and permit him to participate in the counselling under NRI quota for admission to the MBBS course 2025-2026.

2. Heard, the learned counsel appearing on either side and perused all the materials placed before this Court.
3. The petitioner, after completion of his higher secondary examination, appeared for National Eligibility cum Entrance Test UG 2025 and secured 218 marks out of 720. Hence, the petitioner is eligible to get admission to MBBS / BDS course session for the year 2025-2026.
Accordingly, the third respondent commenced online registration and the last date of registration was on 14.07.2025 till 5 p.m. However, the petitioner uploaded his application on 15.07.2025 and submitted documents, but the petitioner failed to upload the required documents such as NRI status certificate and there was delay in production of the same. Therefore, the petitioner's candidature was rejected under NRI quota. While being so, conversion of nationality from Indian to NRI is permitted in the All India NEET-UG Admission process before every round of counselling. Insofar as the year 2024-2025, on 31.08.2024, the Medical Counselling Committee, Government of India had announced that candidates willing to convert their nationality from Indian to NRI 3/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 10/10/2025 10:20:36 pm ) W.P.No.38691 of 2025 can do so, for the round 3 of NEET 2025 counselling. Now, the first and second rounds of counselling are over and the third round of counselling is to be commenced on 11.10.2025 under NRI quota. On this same issue, this Court already considered and permitted the candidature under NRI quota for those who belatedly obtained the required documents.
4. In view of the above, this Court is inclined to issue direction to the respondents in this regard. Accordingly, the respondents are directed to include the petitioner's name in the list of NRI eligible candidates for admission to Puducherry State MBBS NEET-UG counselling 2025-2026 and permit him to participate in the counselling(third round) of Puducherry State MBBS NEET-UG 2025-2026 under NRI quota for admission to MBBS course 2025-2026 subject to verification of all required documents to be produced by the petitioner. It is also made clear that if the petitioner fails to fulfill the production of required documents, the candidature of the petitioner cannot be considered under NRI quota.

5. With the above direction, this writ petition stands disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
