1. Having heard the learned Counsel for the respective parties, the matter is taken up for final disposal at the admission stage.
2. Rule. Rule is made returnable forthwith by consent of the parties.
3. The Petitioners are teachers, who assail the Corrigendum/Shuddipatra dated 2nd February 2026, issued by Respondent No. 2, the Maharashtra State Examination Council ("for short, "Council") whereby it declared that one question was published in four different sets of question papers, i. e., Question Nos. A-147, B-142, C-137, and D-132 has/have been cancelled.

The Respondent No.2-Council had conducted the " Teacher Eligibility Test" (for short, "TET") examination, for which the timetable and schedule of the examination were declared and published by issuing Notification (Exhibit-B) dated 11th September 2025. Pursuant to the Notification, Respondent No.2-Council scheduled the examination on 23 rd November 2025. The Petitioners appeared for the said examination, which was conducted for a total of 150 marks.

The passing eligibility criteria for the candidates belonging to Sonali 16 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:51 ::: WP-2451-2026-J.odt the reserved categories were 82 marks out of 150 marks (equivalent to 55%). For open-category candidates, the criteria were 90 marks out of 150 marks (equivalent to 60%).
7. By Notification dated 19th December 2025, the provisional/interim answer key was published by the Respondent No. 2.
Accordingly, the Commissioner invited objections from the candidates who had appeared for the examination until 27th December 2025, to consider them or any errors, if any, that may have arisen in the answer key regarding the answers mentioned in the said key, and to obtain the opinion of the subject experts, before publishing the final answer key.
8. Pursuant to the said Notification, the candidates lodged their objections with the Council. After considering these objections with the assistance of the subject experts, Respondent No. 2-Council published the final answer key and uploaded it on the website on 12 th January 2026. Subsequently, on 16th January 2026, the Council published the provisional results and called upon candidates to verify them and submit any objections or errors arising during their publication to the Council by 21st January 2026.

9. Thereafter, on 2nd February 2026, Respondent No.2-Council issued the Notification (for short, "impugned Notification"), stating that Question Nos. A-147, B-142, C-137, and D-132, which were identical questions that are apparent across four different sets, were cancelled. Subsequently, the Council published the results of the TET examination. The Petitioner secured only 81 marks out of 149; they were all declared "Not Eligible."
10. After publication of the final result, on 5 th February 2026, the Petitioners approached Respondent No.2, Council and raised objections. The Petitioner No. 1 has categorically raised an objection asserting that, having secured 82 marks and belonging to a reserved category, he is eligible; however, the result erroneously showed him as " Not Eligible". They also requested that it reconsider its decision to cancel the question (s) after the publication of the interim and final answer keys. However, their request was in vain. Consequently, the Petitioners have preferred this Writ Petition.

The learned Advocate for the Petitioners drew our attention to Instruction No.17 in the Question paper/s and emphasised that Respondent No.2-Council did not consider Instruction No.17 in the question paper in its proper perspective and erred in cancelling the said question from all four sets of question papers. The action of issuance of the impugned Notification cancelling the said question is arbitrary and erroneous. It denotes a non-application of mind, and thus the same deserves to be quashed. Drawing our attention to Paper I from Set 'D', the learned Counsel pointed out Question No.132 and submitted that after reading Question No.132 in the English version, the Petitioners answered Question No.132 in the Marathi version. She argued that the Petitioners had correctly solved the question. However, Respondent No.2-Council failed to consider Instruction No.17 in its proper perspective, that if the ambiguity or vagueness appeared in the Marathi and English versions of the Question, then the Question in the English version would prevail. The said facts themselves show that the Petitioners have rightly answered the Question in issue; accordingly, the cancellation of the Question by the Council, thereby reducing the final score by one mark, is arbitrary. This action is erroneous and reflects a lack of application of the mind. To buttress her submissions, she relied on the decisions of the Hon'ble Supreme Court in Kanpur Sonali 19 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:51 ::: WP-2451-2026-J.odt University, through Vice-Chancellor & Ors. vs. Samir Gupta & Ors. 1 and Manish Ujwal vs. Maharishi Dayanand Saraswati University 2, and urged for the quashing of the impugned Notification.

Per contra, the learned Advocate for Respondent No.2-Council strenuously opposed the Petition, contending that, as per law laid down by the Hon'ble Supreme Court in Ran Vijay Singh & Ors. vs. State of Uttar Pradesh & Ors.3, the Council has authority to cancel a question that was wrongly published in the Marathi version to avoid any confusion while allotting the marks. He submitted that, in fact, there was no ambiguity in Question No. 132, but the question in the Marathi version appeared contrary to the English version. Therefore, as per Instruction No. 5, Respondent No. 2 rightly cancelled Question No. 132. He further argued that Question No. 132 was neither vague nor ambiguous, but that the question in the Marathi version was incorrect. Consequently, Respondent No.2-Council acted within its ambit and cancelled the said question. 14. Having heard the learned Counsel for the respective parties, the only question that arises for our consideration is " whether the issuance of the impugned Notification by Respondent No.2-Council, thereby cancelling the only question at issue from all four sets, is just and proper."
15. To ascertain the controversy between the parties, it would be appropriate to reproduce relevant material, namely Instruction Nos. 5 and 17, on which both the parties relied, in the question paper:
"5. If the question is cancelled due to any reason, the eligibility will be decided based on the marks obtained against the accurate question.
\
17. In case of ambiguity between the translation of Marathi or any other medium and the English medium, questions in the English medium will be considered as final for all mediums ."

16. Similarly, we are reproducing Question No.132 in Set 'D' of the question paper, from both versions, as follows:

17. On a bare perusal of Question No.132 in both the English and Marathi versions, it is apparent that the question in the Marathi version is completely contrary to the question in the English version. In the English version, candidates were asked to choose the 'correct pair option' from the given pairs; however, in the Marathi version, they were asked to choose the 'incorrect pair option'. This fact itself indicates that there was no ambiguity in the question or its Marathi translation. Rather, the anomaly was that the action to be performed by the examinees attempting the English and Marathi versions was contradictory. Thus, in our view, Instruction No. 17 does not apply to the present case, as there was no ambiguity or vagueness in the question in the Marathi and English versions, or the question in issue does not fall under Instruction No. 17. Consequently, under Instruction No.5, Respondent No.2-Council is empowered to cancel the question.
What is significant is that the impugned action of the Council is impartial and is uniformly made applicable to all the examinees. All have lost the chance to score a mark in view of the cancellation of the question.Sonali 22 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:51 :::

18. The decisions on which the learned Advocate for the Petitioners relied were considered by the Hon'ble Supreme Court in Ran Vijay Singh (supra). After considering the dictum in Kanpur University, through the Vice-Chancellor & Ors. and Manish Ujwal, the Hon'ble Supreme Court, in paragraphs Nos. 30 and 31, proposed to highlight several significant conclusions and laid down in the form of guidelines, which are reproduced below:
"30. The law on the subject is therefore quite clear, and we only propose to highlight a few significant conclusions. They are:
30.1. If a statute, Rule or Regulation governing an examination permits the re-evaluation of an answer sheet or scrutiny of an answer sheet as a matter of right, then the authority conducting the examination may permit it;
30.2. If a statute, Rule or Regulation governing an examination does not permit re-evaluation or scrutiny of an answer sheet (as distinct from prohibiting it) then the court may permit re- evaluation or scrutiny only if it is demonstrated very clearly, without any "inferential process of reasoning or by a process of rationalisation" and only in rare or exceptional cases that a material error has been committed;
30.3. The court should not at all re-evaluate or scrutinise the answer sheets of a candidate--it has no expertise in the matter and academic matters are best left to academics ;
30.4. The court should presume the correctness of the key answers and proceed on that assumption; and 30.5. In the event of a doubt, the benefit should go to the examination authority rather than to the candidate.
31. On our part, we may add that sympathy, or compassion, Sonali 23 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:51 ::: WP-2451-2026-J.odt does not play any role in the matter of directing or not directing re-evaluation of an answer sheet. If an error is committed by the examination authority, the complete body of candidates suffers. The entire examination process does not deserve to be derailed only because some candidates are disappointed or dissatisfied or perceive some injustice having been caused to them by an erroneous question or an erroneous answer. All candidates suffer equally, though some might suffer more, but that cannot be helped since mathematical precision is not always possible. This Court has shown one way out of an impasse -- exclude the suspect or offending question".

19. A bare perusal of the above guidelines reveals that, in the event of doubt, the benefit should go to the examination authorities rather than to the candidates. Moreover, this is not an adversarial litigation. Therefore, we do not find any illegality in the Council's decision to cancel the question. Thus, in our view, the observations in the decisions cited by the learned Advocate for the Petitioners are hardly of any assistance to them. On the contrary, the law laid down in Ran Vijay Singh (supra) squarely covers the case at hand.
20. Apart from the above, in Manish Ujwal (supra) and in Kanpur University (supra), the facts were that the answer keys were incorrect, yet the students had answered the questions correctly. Consequently, the Hon'ble Supreme Court awarded marks to those students. However, the facts in the case at hand are distinct. Here, the options for pairing were correct. The action to be performed was contradictory to the two sets of Sonali 24 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:51 ::: WP-2451-2026-J.odt examinees who answered in English and Marathi. The Marathi examinees were to set the improper pairs, entirely contradictory to the English examinees, who had to set the proper pairs. To resolve this discrepancy, Respondent No. 2-Council cancelled the question, which the Council was empowered to do. Therefore, in our view, the law laid down in the aforementioned decisions is not helpful to the Petitioners. On the contrary, as concluded in Ran Vijay Singh (supra), Respondent No. 2 has the authority to cancel such a question.
21. We have also gone through the record, which reveals that on 16th January 2026, Respondent No.2-Council published the interim results. The Petitioners annexed the interim result sheet of Petitioner No. 1 to the Petition (Exhibit 'F'). As per the said result sheet, Petitioner No. 1 secured 82 out of 150 marks; however, the Eligibility criterion for passing the examination was shown as 83 marks (55%). A remark in the said result sheet expressly indicates that Petitioner No. 1 was 'Not Eligible'. Similarly, the final result sheet of Petitioner No. 1 (on page 110) shows that Petitioner No. 1 obtained 81 marks out of 149 (54.36%). The required marks for eligibility were shown as 82 (55%); as such, the remark was shown as ' Not Eligible'. Thus, in both the interim and final results, Petitioner No. 1 was shown as 'Not Eligible'.

The learned Advocate for the Petitioners argued that Petitioner No. 1 had obtained 82 marks and was, therefore, eligible and that it was only due to the cancellation of Question No.132 from Set 'D', which reduced his score to 81 marks. He contended that the authority's decision to cancel the question caused prejudice to the Petitioners' rights. However, upon considering the interim result sheet, we find no substance in his argument. According to the interim and final Result Sheets, the eligibility requirement was (55%) marks (i.e. 83 Marks), yet Petitioner No.1 had secured only 82 marks. Thus, even before the question was cancelled, he was shown as 'Not Eligible'; he did not meet the criteria. Consequently, we find no merit in the Petitioners' contentions in this regard.
23. The Petitioners, though, claim to belong to reserved categories, for which the eligibility criterion was 82 marks out of 150 (equivalent to 55%). However, the interim result sheet reveals that the Petitioners were required to obtain 83 marks to be declared Eligible for the TET examination. Following the cancellation of one question by Respondent No. 2-Council, their scores were reduced to 81; therefore, in our view, it cannot be said that the Petitioners obtained the required 55% to claim eligibility. Thus, we find no error in the declaration of results by Respondent No. 2-Council.

It is pertinent to note that on 16 th January 2026, Respondent No. 2- Council published the provisional result on the website, and also issued the Notification dated 16th January 2026, thereby asking the candidates to verify the marks and inviting their objections or errors, if any occurred during the allotment of the marks by 21 st January 2026. However, it does not appear that the Petitioners had raised any objections until 21 st January 2026. Then, upon considering the objections received by the Council and on the advice of the subject experts, the Council issued the impugned Notification dated 2nd February 2026, thereby cancelling the Question in issue. Subsequently, on 3rd February 2026, the final result sheet was issued/published. Afterwards, on 5th February 2026, only Petitioner No. 1 and some other Petitioners raised their objections before the Council regarding the cancellation of the Question. Nothing is produced on record to demonstrate that after issuance of Notification dated 16th January 2026, they raised the objections before the Council until 21 st January 2026, or cancellation of the question on 2 nd February 2026, or the declaration of the final result sheet till 3rd February 2026.
25. Having considered the above discussion and, in light of the dictum in Ran Vijay Singh (supra), we find that the Petitioners have failed Sonali 27 ::: Uploaded on - 26/03/2026 ::: Downloaded on - 26/03/2026 23:36:52 ::: WP-2451-2026-J.odt to make out a case for the invocation of Article 226 of the Constitution of India. Consequently, the Petition lacks merit and is dismissed.
26. Accordingly, the Rule is discharged. There shall be no order as to costs.
