Shri A.R. Bain, learned Deputy Government Advocate for the State. Applicant has filed first application under Section 439 of the Code of Criminal Procedure as he is in custody since 23.03.2022 in connection with crime No.178/2022 registered at Police Station-Deori, District-Sagar (MP) for offence punishable under Section 302 of the IPC.
Heard on I.A.No.16319/2022, an application for grant of ad-interim bail filed by the applicant.
Learned counsel appearing for the applicant submitted that applicant has filed an application for grant of ad-interim bail on ground that applicant is suffering from paralysis. Medical Officer, Central Jail, Bhopal (MP) has sent its report dated 14.09.2022. As per said report, applicant is suffering from malignant new plasma of brain. He is being referred to higher center for further management, therefore, applicant may be granted ad-interim bail.
Considering the seriousness of the disease suffering by applicant, I.A.No.16319/2022 filed by applicant, is allowed.
It is directed that the applicant shall be released on ad-interim bail for a period of two months on his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial Court.
Applicant shall surrender after completion of two months before the trial Court and file copy of his treatment and health status.
2The applicant shall abide by the conditions enumerated under Section 437(3) of Cr.P.C.
List the matter after two months for consideration. Certified copy today.
