                                         ORDER

1. The Appellant filed an RTI application dated 25.05.2024 seeking information on the following points:

1) Pitambar Thanpati, MSD working at HAL, Sunabeda and this month he take retirement. Please provide his MBA certificate.

2) Due to his MBA certificate when he got promotion in HAL Please mention.

3) If it is a duplicate certificate then what action taken by HAL in this short period of time before his retirement like his retirement benefits stop or what please mention.

2. The CPIO replied vide letter dated 21.06.2024 and the same is reproduced as under:-

1: No information or record regarding MBA certificate of Sri Pitambar Thanpati is available in the records maintained by HAL, Koraput Division, Sunabeda. Hence, the same is not provided.

2-3: In view of reply against Point No. 1 mentioned above, no information is required to be provided.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 25.06.2024 alleging that no response was provided within time limit. As per documents submitted by the Appellant the First Appeal was not adjudicated by the First Appellate Authority.

4. Aggrieved with the non-receipt of FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 29.08.2024.

5. The appellant appeared through video conference and on behalf of the respondent Mr. Tanvir Ahmed - DGM(IT) attended the hearing through video conference.

6. The appellant inter alia submitted that he was dissatisfied by the fact that information sought by him had not been provided.

7. The respondent while defending their case inter alia submitted that the appellant had been duly informed by the CPIO vide letter dated 21.06.2024 that information sought by the appellant was not available in the records maintained by HAL, Koraput Division, Sunabeda and hence the same could not be provided to him. He further mentioned that the First Appeal had been duly decided vide order dated 24.07.2024, upholding the PIO's reply copy, whereof had been duly placed on record.

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records, observed that information sought by the Appellant had been duly informed by the respondent that the same is not available on records of the respondent public authority. Even if it would have been available, since the document is an educational certificate pertaining to a third party, it would be barred from disclosure Page 2 of 3 under provisions of the Section 8(1)(j) of the RTI Act. Be that as it may, considering the fact that the document sought is not available on records with the respondent public authority as has already been intimated to the appellant, the Commission finds no requirement for further adjudication in the instant matter, under the RTI Act. Accordingly, the appeal at hand is dismissed.
