1. This order disposes of a second appeal dated 27.6.13. During the hearing, appellant was absent and respondent is represented by Shri S.E. Rizwi, Deputy Secretary.
2. Present appellant has filed an RTI application on 12.12.12 requesting to obtain file notings, communications, information on selection of Shri Arup Roy Chowdhury as CMD of NTPC and rejection of Shri Shyamal Ray to the post of CMD. Appellant requested this information claiming that it concerns the life and liberty.
3. Respondent CPIO transferred the RTI application to Ministry of Power on 19.12.12, since the subject matter related to NTPC.
4. FAA,PMO in his order dated 22.5.13, has upheld the actions of transfer of RTI application to Power Ministry stating that the contents of RTI application were a subject matter of Power Ministry.
5. In her RTI application, appellant has taken a plea that a false and motivated FIR was lodged against her husband; therefore, the information sought concerns life and liberty. Commission is of the view that no case of life and liberty has been made out. Further, the PMO has transferred the appellant's RTI application on the day of receipt of the RTI application and the action to transfer the RTI application is satisfactory since the matter related to the CPIO, Power Ministry who has also responded to her RTI application. However, if the appellant is still dissatisfied with the information obtained, she may prefer an appeal before the appropriate authority.
6. With these observations, this appeal is disposed of.
