JUDGMENT

This Public Interest Litigation has been filed for a direction to remove all the transformers and its poles from footpaths and road margins. Petitioner has submitted Ext.P7 representation to the respondents requesting them to remove all transformers and its poles from footpaths or road margins and not to grant any permission or clearance to the third respondent for installing any transformers on footpaths or road margins. According to him, Ext.P8 letter has been issued by the Director (Distribution & Safety) of KSEB without redressing the grievances of the petitioner, ignoring and misinterpreting the statutory provisions conveniently to their undue advantage. Being aggrieved, petitioner has approached this Court seeking for the following reliefs:
"i. to issue a writ of mandamus or any other appropriate writ, direction or order commanding the third respondent to remove all transformers and its poles from footpaths and road margins in the State at their own expense for free movement of the pedestrians;
ii. to issue a writ of mandamus or any other appropriate writ, direction or order commanding the respondents not to grant permission to install transformers on footpaths or road margins where its width is less than 1.5 meters.
iii. to issue a writ of mandamus or any other appropriate writ, direction or order commanding the respondents to provide and maintain at least a W.P.(C)No.4280 of 2016 4 bare minimum width of 1.5 meters as footpath or road margin without any obstructions and encroachments."
2. Kerala State Electricity Board Limited (KSEB), Thiruvananthapuram (Respondent No.3) has filed a counter affidavit dated 27.5.2019, contending inter alia as under:
"11. The averments of the petitioner that walking under and nearby transformer is a safety hazard and that is violation of article 21 of the constitution is incorrect. On the contrary, in State of Karnatake v. Narasimhamurthy (1995 (5) SCC 524: JT(1995) 6 SC 375 SCC (p) 526, para 7: JT at p.378, para 7), Hon'ble Supreme Court held that right to shelter is a fundamental right under Article 19(1) of the Constitution. Further in Chameli Singh Vs. State of U.P. Appeal (civil) 12122 of 1995, Hon'ble Supreme Court observed that "in any organized society, right to live as a human being is not ensured by meeting only the animal needs of man. It is secured only when he is assured of all facilities to develop himself and is freed from restrictions which inhibits his growth. All human rights are designed to achieve this object. Right to live guaranteed in any civilized society implies the right to food, water, decent environment, education, medical care and shelter. These are basic human rights known to any civilized society. All civil, political, social and cultural rights enshrined in the universal declaration of human rights and convention or under the constitution of India cannot be exercised without these basic human rights. Shelter for a human being, therefore, is not a mere protection of his life and limb. It is home where he has opportunities to grow physically, mentally intellectually and spiritually. Right to shelter, therefore includes adequate living space, safe and decent structure.... electricity.W.P.(C)No.4280 of 2016 5
Since the installation of transformers are essential for providing electric connection, including domestic connection, any restriction on installation of transformers will ultimately lead to non electrification of the premises, and in turn result in violation of Article 19 of Constitution of India.
12. The judgment in Olegea Tellis & Others V. Bombay Municipal Corporation by the Apex Court was delivered when the state of Maharashtra and Bombay Municipal Corporation took a decision that all pavement dwellers and the slum or busti dwellers in the city of Bombay will be evicted forcibly and deported to their respective places of origin or removed to places outside the city of Bombay. This has no implication in the case built by the petitioner.
13. As per the statutes, a distribution licensee does not require approval from public works department, National Highways, Road Safety or Electrical Inspectorate Authorities or local self government for placing lines and plants, including 11 KV installations. As already pointed out as per provisions of section 164 of Indian Electricity Act 2003, KSEB is empowered to impose any of the provisions of the Indian Telegraph Act, 1885 which the telegraph authority possess under the Act for placing of electric lines or electrical plant. By the provisions of Telegraph Act 1885, the telegraph authority may from time to time, place and maintain a telegraph line under, over, along or across and posts in or upon any immovable property.
Further section 174 (Act to have overriding effect) of Electricity Act 2003 read as follows: "Save as otherwise provided in section 173, the provisions of this Act (Electricity Act, 2003) shall have effect not withstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act (Electricity Act 2003).
14. Ahmedabad Municipal Corporation Vs. Nawab Khan Gulab han & Ors. before the Hon'ble Supreme Court of India was consequent to evacuation W.P.(C)No.4280 of 2016 6 of some of the pavement-dwellers who were in unauthorized occupation of footpaths by corporation. In that case the Apex Court observed that it would be inexpedient to give any direction not to remove, or to allow the encroachment on the pavements or footpaths which is a constant source of unhygienic ecology, traffic hazards and risk prone to lives of the pedestrians. This does not have any relevance in the present case. In the instant case KESB is not occupying the space unlawfully; on the contrary it is carrying out statutory responsibility of providing electric supply to public. It doesn't violate any fundamental or constitutional rights.
15. The averment of the petitioner that the beneficiaries of distribution transformers are the elite group of the society is not correct and intended to mislead this Hon'ble Court. There are more than 73,340 Distribution Transformers in the licensing area of these respondents. Most of these are installed at Government Puramboke in the shoulders along the public path. This has been feeding more than 1.25 Cr consumers across the state. About 93% of these consumers are availing single phase supply (normally with connected load below 5 KW) More than 82% of our consumer base falls under domestic category. As per regulation Consumers having high connected load/contract demand avail service at 11KV level by installing or install separate transformers within their premise.
The averment of the petitioner that KSEBL is not installing transformers in low voltage area is also not correct. To cite an example, out of the 3300 Distribution Transformers erected during the financial year of 2016- 17 2100 were are for system/voltage improvement and other normal developments. Remanding transformers were for meeting the additional requirement of 4 lakh consumers expected to be added in the said year.
16. The answering respondents have received a request from the petitioner for removal of transformers and poles from Footpath. On receiving the same it had been conveyed to the petitioner that electricity W.P.(C)No.4280 of 2016 7 has become bare necessity in a civilized society and that transmission and distribution of electricity and installation of towers/pole, overheads/underground cables, transformer stations and control gears cannot be dispensed with. After explaining in all these details, petitioner was assured that KSEB is bound to maintain statutory clearance to ensure safety of public and the operating staff. Petitioner was also requested to bring to the attention of concerned officers is there are any specific instance of violating the norms for taking remedial measures. But the petitioner did not approach these respondents later with details of such violations if any. However in the light of the said petitions, board vide letter No.D9D&S)/D6/AE 1/00298/15 dated 31.12.2015 had already reminded the field officers to maintain statutory clearance as stipulated by safety rules & regulations and to avoid inconvenience to public while installing lines & plants. Vide letter dated 1.1.2016 it has been directed that the field officers of the board shall see that statutory clearance shall invariably be maintained in all installations, and that special care shall be taken to minimize inconvenience to pedestrian & vehicular movement while installing lines & plants along the public path. Existing installations which form potential threat to pedestrian & vehicular movement may be relocated wherever possible. Protective guarding/fencing may be provided wherever necessary for avoiding mishaps. The true copy of the letter dated 1.1.2016 is produced herewith and marked as Exhibit R3 D.
17. While disposing WPC.No.11804 of 2015, vide R3 B judgment this Hon'ble Court held that the petition cannot be entertained as a matter of public interest litigation.
18. It is submitted that consequently these respondents are taking earnest efforts to renew all transformer structures and have relocated the possible installations for avoiding any kind of potential threat to pedestrian and vehicular movement. However considering the magnitude of transformer stations, this target can be achieved only in a phased W.P.(C)No.4280 of 2016 8 manner. Field officers are advised to renew at least one transformer structure in a month. The true copy of the photographs of some of the renovated structures are produced herewith and marked as Exhibit R3 E. The instances which are pointed out in the petition were examined and appropriate measures were taken accordingly.
19. It is submitted that Ext.P2 (online edition of the Mathrubhumi daily dated 23.11.2015) the structure shown in the daily is not a transformer, but an AIR Break switch installed structure with section fuses. The open fuse has been replaced with fuse carriers. This structure is proposed to be shifted to more convenient location on account of the road widening work of NH 47.
20. Ext.P3 & P4 are transformers installed under the jurisdiction of Electrical Section College under electrical circle, Ernakulam. The transformer are pole mounted type and situated between the footpath and northern border of the DH Road. Since the transformers are installed at adequate height, these structures do not cause any hindrance to the traffic and pedestrians. Also there is no safety issue in connection with these structures.
21. Ext.P5 is a transformer installed on the south east corner of Banerji Road and market road junction under Electrical Section Central under electrical circle, Ernakulam. There is a sewage canal covered by concrete slab of width 2m in between the transformer and Banerji Road is 3.5m and market road is 2m. The present location is not causing any hindrance to the pedestrians and vehicles.
22. Ext.P6 are transformers installed at Plamoodu Junction under Electrical Section, Cantonment under Electrical Circle, Thiruvananthapuram. Fencing has been provided for transformers at Plamoodu 1 & 2."

Inviting the attention of this Court to the newspaper report dated W.P.(C)No.4280 of 2016 9 20.2.2013 (Ext.P1), Mr.T.H.Abdul Azeez, learned counsel for the petitioner submitted that the transformer is installed at the edge of the road causing inconvenience to the pedestrians and that it is dangerous. Similar request is made for removal of the transformer depicted in Exts.P2, P3, P4, P5 and P6 photographs. Referring to Regulation 43 of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010, learned counsel for the petitioner further submitted that approval by the Electricity Inspector has not yet been obtained. It is also his contention that periodical inspection as contemplated in Regulation 30 of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010 has not been done.

Per contra, Mr.B.Premod, learned standing counsel for the Kerala State Electricity Board Limited (KSEB) submitted that installation of transformers would be done only after approval by the Electrical Inspector and most of the installations of transformers in the State of Kerala have been done 20 years ago, in terms of the Indian Electricity Act, Regulations and Rules made thereunder. On the prayer for removal of the transformers, learned standing counsel for the KSEB refers to the reasons set out in the counter affidavit. According to him, adequate safety measures have been taken and no untoward incident has been reported. As regards the relocation of the transformer in Ext.P1, learned standing counsel for the KSEB submitted that W.P.(C)No.4280 of 2016 10 the said transformer is located in Palarivattom, Cochin Corporation and discussion is conducted between the KMRL and Cochin Corporation regarding relocation of the transformers. In support of the above contention, he has also placed a message of the Deputy Chief Engineer, Ernakulam dated 18.10.2019, which reads thus:
Dear All, As per KMRL Phase II Metro corridor which is from JLN Stadium to Infopark via Kakkanad, for the preparatory work for metro construction, the existing road is to be widened to 22 m. For carrying out the widening work as well for the construction of metro piers some of the utility lines provided in the road by various service providers are to be shifted or re- aligned. In connection with this, a stakeholder meeting is scheduled on 23rd October 2019, Wednesday, 3:00 pm at 8th Floor, Kochi Metro Rail Limited, Revenue Tower, Park Avenue, Ernakulam. All concerned may please attend the meeting with the alignment plan of the existing service lines.

From the above, it could be deduced that though there are statutory provisions regarding installation of the transformers, all the same cannot be implemented in letter and spirit due to paucity of space in State of Kerala. If any new footpath has to be laid, it will certainly narrow the width of the existing roads and make the vehicular traffic more congested. In such a view of the matter, prayer sought for by the petitioner cannot be granted.
Depending upon the outcome of the discussion between Kochi Metro Rail Limited and the Electricity Authorities, re-alignment and relocation of transformers be done, as expeditiously as possible, causing less inconvenience W.P.(C)No.4280 of 2016 12 to the consumers. As rightly pointed out by the learned counsel for the petitioner, it is desirable to have periodical inspection as contemplated in Regulation 30 of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010. For brevity, Regulation 30 is extracted hereunder:
"30. Periodical inspection and testing of Installations:- (1) Where an installation is already connected to the supply system of the supplier or trader, every such installation shall be periodically inspected and tested at intervals not exceeding five years either by the Electrical Inspector or by the supplier as may be directed by the State Government in this behalf or in the case of installations belonging to, or under the control of the Central Government, and in the case of installation in mines, oilfields and railways, by the Central Government.
(2) The periodical inspection and testing of installations of voltage above 650 V belonging to the supplier, shall also be carried out at intervals not exceeding five years by the Electrical Inspector, (3) Where the supplier is directed by the Central or the State Government, as the case may be, to inspect and test the installation, he shall report on the condition of the installation to the consumer concerned in the Forms I, II and III as specified in Schedule-IV and shall submit a copy of such report to the Electrical Inspector, (4) The Electrical Inspector may, on receipt of such report, accept the report submitted by the supplier or record variations as the circumstances of each case may require and may recommend that the defects may be rectified as per report, (5) In the event of the failure of the owner of any installation to rectify the defects in his installation pointed out by the Electrical Inspector in his report and within the time indicated therein, such W.P.(C)No.4280 of 2016 13 installation shall be liable to be disconnected under the directions of the Electrical Inspector after serving the owner of such installation with a notice for not less than eight hours.
Provided that the installation shall not be disconnected in case an appeal is made under sub-rule (1) of rule (8) of "Qualifications, Powers and Functions of Chief Electrical Inspector and Electrical Inspectors issued by Central Government vide GSR 481 (E). dated 17.08.2006 and the appellate authority has stayed the orders of disconnection."
6. The Chief Electrical Inspector, Thiruvananthapuram (respondent No.8), shall pass necessary orders for enforcement of Regulation 30 of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010, in co-ordination with the other stakeholders. Such exercise be undertaken within three months from the date of receipt of a copy of this judgment.
With the above directions, this writ petition is disposed of.
