Counsel for the petitioners submitted that this Court in S.B. Civil Writ Petition No. 27775/2018 (Pawan Kumar Yadav Vs. State of Rajasthan and Ors.) dt. 13th December, 2019, has passed interim order and has permitted the similarly situated persons to participate in the examination of MBBS III Professional Examination Part-II.
Counsel further submitted that the respondents have declared the dates of examination from 9th January, 2020 and as such request is made to pass similar order.
Counsel for the respondents submitted that some time may be granted to seek instructions and to inform this Court about the (Downloaded on 09/01/2020 at 09:12:56 PM) (3 of 3) [CW-72/2020] rights of the petitioners, which are agitated in the present writ petition.
This Court considering the fact of passing the similar order in S.B. Civil Writ Petition No. 27775/2018 (Pawan Kumar Yadav Vs. State of Rajasthan and Ors.) dt. 13th December, 2019, deems it proper to direct the respondent-University to accept the examination form of the petitioners of MBBS III Professional Examination Part-II and petitioners may further be permitted to participate in the ensuing examination of January, 2020.
It is made clear that filling of the examination form and participation in the examination, will not create any right in favour of the petitioners and it will remain subject to final outcome of the writ petition.
List the matter along with S.B. Civil Writ Petition No. 27775/2018 on 20th January, 2020.
