 HC-KAR

THIS APPEAL, COMING ON FOR ORDERS, THIS DAY,
JUDGMENT WAS DELIVERED THEREIN AS UNDER:

CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE
       and
       HON'BLE MR. JUSTICE C.M. POONACHA

                         ORAL JUDGMENT

(PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)

1. The appellant has filed the present appeal impugning an interim order dated 11.07.2025 passed by the learned Single Judge of this Court in WP.No.20617/25 (EDN-RES). In terms of the impugned order, the learned Single Judge had directed the appellant to issue hall ticket and permit the writ petitioner to appear in the Semester-II examination scheduled to commence on 14.07.2025. The impugned order was passed taking into consideration the urgency claimed by the writ petitioner. However, the Court had also clarified that the interim order was subject to the result of the writ petition and that the writ petitioner would not claim any equities in the matter. The semester examination which was scheduled to commence on 14.07.2025 is over and therefore the interim order has worked itself out.

NC: 2025:KHC:41970-DB WA No. 1164 of 2025 HC-KAR

2. As is noted above, the writ petitioner is not entitled to claim any equities on account of having been permitted to appear in the semester examination. If the writ petitioner fails in this writ petition, he would derive no benefit from the fact that he had appeared in the semester examination or had cleared the same.

3. The learned counsel appearing for the appellant submits that the writ petitioner would claim further reliefs ‒ for declaration of result; and for promotion to the next class, which would further complicate the matter.

4. We find that the appellants' apprehension is not well founded. The impugned order is unambiguous and if the writ petitioner does not prevail in the writ petition, he can derive no benefit whatsoever from being permitted to appear in the Semester-II of the Bachelor of Engineering (Computer Science Department) examination.

5. In view of the above, we do not consider it apposite to interfere with the impugned order. Needless to state that the -4- NC: 2025:KHC:41970-DB WA No. 1164 of 2025 HC-KAR appellant is at liberty to raise all grounds before the learned Single Judge.

6. Considering the nature of controversy, we also request the learned Single Judge to dispose of the said petition as expeditiously as feasible.

7. The appeal is dismissed with the aforesaid observations.

8. Pending application stands disposed of.
