Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.15 dated 07.02.2018 registered under Sections 324, 323, 148, 149 IPC (Section 326 added later vide Diary No.19 at Police Station Dhariwal, District Gurdaspur.

Counsel for the petitioner has submitted that as per the allegation in the FIR, the petitioner namely Arshdeep Singh @ Arsh Singh is attributed 03 injuries on the person of injured namely Pardeep Singh, who suffered 03 blows with a datar which hit on front side of his leg, little finger of left hand and ring finger of left hand. A perusal of the FIR further show that apart from the petitioner, his co-accused namely Sukhwinder Singh has also given multiple injuries to the complainant. The only argument raised by counsel for the petitioners is that as per the X-ray report, the injury attributed to the petitioner is unicortical fracture on tibia and the same cannot be termed as a grievous injury as per Section 320 IPC.

After hearing counsel for the petitioners, I find no merit in the present petition. A perusal of the FIR show that the complainant -

1 of 2 ::: Downloaded on - 20-05-2018 12:13:35 ::: Pardeep Singh was attacked by the petitioner along with his father Sukhwinder Singh @ Sukhi and 5-6 unidentified persons and the petitioner by raising a lalkara instigated the other co-accused to teach a lesson to the complainant for not leaving the passage. Considering the fact that the injured/complainant - Pardeep Singh was given multiple injuries with different weapons by the petitioners and other co-accused, no ground for grant of anticipatory bail to the petitioners is made out.

Dismissed.
