Information sought:
The Appellant sought to know the total area in square feet that was mutated in the name of Prem Kishore Arora vide CBR no. 01 dated 29.09.2014.
Grounds for the Second Appeal:
The CPIO has not provided the desired information.
Relevant Facts emerging during Hearing: The following were present:-1
Appellant: Not present.
Respondent: Ashutosh Verma, Town Planning Asstt. & Draftsman & Rep. of CPIO, Cantonment Board, Jhansi present through VC.
Rep. of CPIO submitted that appropriate reply has been provided to the Appellant on 26.08.2019 i.e., after receiving notice for hearing. He regretted for the same because area calculation was not available readily and clearance had to be obtained from higher authorities under Southern Command, Pune.
On Commission's instance, Rep. of CPIO mentioned that Mayank Mani Chaturvedi, Chief Cantt. Engineer is the CPIO from the date of receipt of RTI Application and could not attend the hearing because of a building collapse in the area.
Decision Appellant has not availed the opportunity to appear before the Commission to plead his case/contest CPIO's submission. Commission upholds the submission of the CPIO. No further action lies.
Commission severely reprimands Mayank Mani Chaturvedi, Chief Cantt. Engineer, CPIO for sending delayed response to the Appellant. A copy of the order is also marked to CEO for taking note of adverse observations of the Commission.
The appeal is disposed of accordingly.
