ORDER
This is third bail application under Section 483 of BNSS filed by the applicant for grant of bail after dismissal of earlier one on merits vide order dated 08.09.2025 passed in M.Cr.C. No. 40622 of 2025 by this Court.
2. The applicant has been arrested on 28.07.2024 in connection with crime No.58/2024 registered at Police Station Crime Branch District Gwalior for offence punishable under Sections 178, 179, 180, 181 of IPC.

The prosecution story, in brief, is that on receiving secret information regarding the manufacturing and circulation of counterfeit Indian currency in the market at Jagrati Nagar, Laxmiganj, the police conducted a raid at a house. During the raid, the present applicant, Ansar Ali, along with co-accused Ashok Mahor, were apprehended. In their disclosure statements, it was revealed that both were allegedly engaged in counterfeiting currency and circulating it in exchange for genuine notes. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the earlier bail application of the applicant was dismissed on merits, with liberty to revive the prayer after the examination of the principal prosecution witnesses. Ramakant Upadhyay (PW-4), who is a Sub-Inspector (PW-4) was examined on 07.11.2025, and he stated that a colour printer was seized from the accused at the spot. However, the connecting wire, laptop, and data cable related to the printer were not seized, suggesting that the recovery of the printer may have been planted. There are a total of five accused in the present case, out of whom four have already been granted bail. The charge- sheet has been filed, and the investigation is complete. The applicant has been in custody since 28.07.2024, and the trial is likely to take considerable time to conclude. The applicant is a permanent resident of District Bhind, and there is no likelihood of absconding or tampering with prosecution evidence. On these grounds, it is prayed that the benefit of bail may be extended to the applicant.
5 On the other hand, learned counsel for the State vehemently opposed the application, submitting that a total of 739 counterfeit currency notes were recovered from the possession of the present applicant. Furthermore, it was emphasized that the applicant has criminal antecedents involving five prior criminal cases
6. Heard the counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, period of Signature Not Verified Signed by: YOGENDRA OJHA Signing time: 11/18/2025 11:11:57 AM NEUTRAL CITATION NO. 2025:MPHC-GWL:29377 3 MCRC-52615-2025 custody of the applicant coupled with the fact that the trial is not likely to conclude in near future and prolonged pre- trial detention being an anathema to the concept of liberty, this Court is inclined to extend the benefit of bail to the applicant.
8. Accordingly, without commenting on the merits of the case, this bail application is allowed. It is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the concerned trial Court for his appearance before it on the dates given by the concerned Court.
9. This order will remain operative subject to compliance of the following conditions by the applicant:-
(i) The applicant will comply with all the terms and conditions of the bond executed by him;
(ii) The applicant will cooperate in the investigation/trial, as the case may be;
(iii) The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;
(iv) The applicant shall not commit any other offence during pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;

(vi) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
(vii ) The applicant is directed to mark his presence before the concerned police station on every Sunday between 12:00 noon to 2:00 pm.
