ORDER
This Writ Petition has been filed challenging the order passed by the 2nd respondent dated 02.01.2025 thereby cancelled the conditional patta issued in favour of the petitioner.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner and 4 others were initially granted conditional patta (D Namuna Patta) in respect of the land comprised in S.No.339/20 measuring to an extent of 1.25 sq.mtr. (3 cents) each. Pursuant to the issuance of D Namuna Patta, the petitioner had put up a thatched house in the subject land. However, due to a natural calamity caused by a cyclone, the thatched house put up by the petitioner was completely damaged. Thereafter, the 2nd respondent, without conducting any enquiry and without issuing any notice, straightaway cancelled the D Namuna Patta assigned in favour of the petitioner and four others, on the ground that the petitioner had violated the conditions prescribed therein.

As per the conditions of the D Namuna Patta, the petitioner was required to construct a house within a period of one year from the date of 2/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 29/10/2025 05:56:02 pm ) W.P.No.38564 of 2025 assignment. Accordingly, the petitioner constructed a thatched house within the said period, however, the same was subsequently damaged due to a natural calamity and the subject land is now lying vacant. Despite these facts, the 2nd respondent has mechanically passed the impugned order, without affording any opportunity of hearing to the petitioner or the other beneficiaries, and without conducting any enquiry, merely stating that the petitioner failed to comply with the conditions prescribed in the D Namuna Patta. Therefore, the impugned order passed by the 2nd respondent is in clear violation of the principles of natural justice. Hence, the impugned order passed by the 2nd respondent cannot be sustained and is liable to be set aside.
5. Accordingly, the order passed by the 2nd respondent dated 02.01.2025 is quashed, and the matter is remitted back to the 2nd respondent for fresh consideration. The 2nd respondent is directed to issue notice to the petitioner and other similarly placed persons, conduct an enquiry after affording them an opportunity of personal hearing, and thereafter pass appropriate orders on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition stands allowed. No costs. Consequently, the connected Miscellaneous Petition is closed.
