Prayer is It granted under Rule 4(5}(a) of the CAT (Procedure) Rules, HI 1987, 2, Learned counsel for the applicants submitted | that all the applicants are working in various categories in ihe office of the Accountant General, Mizoram, Aizawl in ithe State of Mizoram. According to the learned counsel, 697 employees who are working in different departments of the Central Government working at Aizawl, Mizoram filed OA.381/2000 before this Tribunal claiming benefits of HRA applicable to 'B' class cities which was allowed by a Soe ate " ark this Tribunal vide order dated! 12.04.2012. The said order has been upheld by the Hon'ble High Court by judgment and order dated 25.04.2003 in WP (C}) No. 2955/2003 as TR arte te ener eee well as Hon'ble Supreme Court by judgment and order ety dated 17.07.2013 in Civil Appeal No. 646/2005. Pursuant thereto, the applicants thereto, the Union of India seen ieee Fa ~~ atont, Ee, ieee toll att ocelS implemented the order dated 12.04.2002 in respect of the A hit applicants in ©A.381/2000. Learned counsel further 16 submitied that applicants have filed representations on various dates ie., 04.05.2016, 09.05.2016, 10.05.2016, 11.05.2017 and 17.05.2016 seeking permission draw 20% HRA at the rate of 'B' class city but to no avail. According to the learned counsel, said benefits have not been granted to the applicants as they were not the applicants in OA.381/2000. Learned counsel submitted that since the issue of entitlement of HRA at the rate of 20% Le., in the 'B' class city rate on posting at Aizawl, Mizoram has diready been setiled by the Hon'ble court, denial.of such benefits to the present applicants is discriminatory.
3. Learned counsel submitted that one similarly situated employee, namely Sri sukha Ram Bishnoi posted at Aizawl filed OA.044/00039/2017 claiming HRA at the tate of B class cities. This Tribunal, vide order dated 08.03.2017, directed the respondents that in case the applicant is similarly situated wifh the applicants of OA.381/2000, similar benefits be granted to the applicant therein. 4, | In view of fhe above submission, in the interest of speedy justice, it is considered sufficient to direct the respondents that in case the applicants are similarly situated wiih the applicants in O.A. No. 381/2000 decided on 12.04.2002 and upheld by the Hon'ble Gauhaii High vide judgment and order dated 25.04.2003 in WP (C) No. 2955/2003 as well as Hon'ble Supreme Court vide $46/2005, similar benefits be "granted to the applicants joo.
