The learned Public Prosecutor-in-Charge has submitted a report of the Investigating Officer. Let the report be kept with the record.

Titagarh Police Station Case No.347/18 was registered on 11th June, 2018 under Sections 419/420/493/376/323/506 of the Indian Penal Code. Investigation of this case culminated in filing charge-sheet No.451/18. Now the parties have prayed for a joint petition for compromise, stating, inter alia, that the dispute has been amicably settled. There was a consensual physical relationship subsequently. Due to certain dispute the de-facto complainant filed the written complaint against the accused and a case under Sections 2 419/376 of the Indian Penal Code along with other penal provisions was registered. Since the matter has been compromised, the parties may be allowed to get G.R. Case No.3285/18 dispose of on the basis of the compromise petition.

Since the petitioner and the private opposite party are now living together as husband and wife and in their wedlock a child is born, the Additional Chief Judicial Magistrate, Barrackpore is directed to immediately commit G.R. Case No.3285/18 to the learned Sessions Judge.

The learned Sessions Judge shall examine both the petitioner and the opposite party and dispose of the case in accordance with law within one month from the date of this order.

The parties are at liberty to act on the server copy of the order.
