               WRIT PETITION No.40828 of 2025
                         Dated: 25.03.2026

Between:

                              And
The State of Telangana,
Rep. by its Principal Secretary, Home
Secretariat, Hyderabad and four others
                                                  ... Respondents

                                   ORDER:

The present Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-

''... to issue a writ more particularly in the nature of Mandamus declaring the action of the respondent No.3 not taking any action on my complaints of 2024 or the complaint recently lodged on 05.11.2025 is challenged in this writ petition as being illegal, arbitrary and violative of Articles 14, 19(1)(g), 21 and 300-A of The Constitution of India consequently, direct the respondent No.3 to initiate the action against respondent No.4 and 5 for the offences under Section 406 and 420 of IPC or Section 316 and 318 of BNS and prosecute the as per law and pass such other order or orders ..."

2. Heard Mr.Vijay B. Paropkari, learned counsel for the petitioner, Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3. Perused the record.

2

3. Learned Assistant Government Pleader for Home by filing the copy of written instructions dated 05.01.2026 addressed by the Sub-Inspector of Police, Bhongir Town Police Station, Yadadri Bhongir District contends that the complaint filed by the petitioner was closed as 'civil in nature' and the same was intimated to the petitioner through Petition Management System.

4. This Court on 05.01.2026, directed respondent No.3 to be present before this Court by the next date of hearing i.e., on 07.01.2026. Further, directed the learned Assistant Government Pleader for Home to inform the same to respondent No.3. This matter was adjourned to 08.01.2026, 09.03.2026 and 24.03.2026. On 24.03.2026, this Court observed that the order dated 05.01.2026 was not being complied with. Therefore, this Court had again directed respondent No.3 to appear on 25.03.2026. Today, i.e. on 25.03.2026 there is no representation appearance on behalf of respondent No.3.

5. At this stage, learned Assistant Government Pleader for Home contends that inadvertently, he could not inform the 3 direction passed by this Court to respondent No.3 and the same is neither intentional nor wanton.

6. In view of the aforesaid submissions, taking the copy of written instructions dated 05.01.2026 onto the file and upon considering the fact that the complaint filed by the petitioner was closed as 'civil-in-nature', this Court, by setting aside the order dated 24.03.2026, deems it appropriate to dismiss this Writ Petition.

7. Accordingly, this Writ Petition is dismissed. No costs. The petitioner is granted liberty to work out the remedies as available under law.

Miscellaneous Petitions, pending if any, shall stand closed.
