Mrs. Sabita Khutia (Bhunya) ... For the petitioner Mr. Debabrata Chatterjee ... for the State Let affidavit of service filed today be kept on record. Learned Counsel appearing for the writ petitioner submits that there is delay in payment of gratuity. He submits that the writ petitioner is entitled to get interest for delayed payment of gratuity.
Heard the learned Counsel appearing for the parties. Now it is settled that the writ petitioner is entitled to get interest against delayed payment of gratuity. The State authorities have also agreed to pay 8% interest per annum for the delayed period. Therefore, so far the rate is concerned, there cannot be any dispute.
However, considering the facts and circumstances of this case, I direct the concerned Treasury Officer to pay 8% interest per annum on the unpaid gratuity amount in favour of the writ petitioner for the delayed period from the date of retirement till the date of making payment of 2 gratuity.
The entire exercise is to be completed within a period of ninety days from the date of communication of this order.
The writ petition is, thus, disposed of. There would be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be furnished to the appearing parties on priority basis.
