JUSTICE ALOK SHARMA Order 07/07/2017 The issue in the petition is as to whether the petitioner who secured 44.72% marks in the Bachelor Degree examination fulfills the requirement of the University of Rajasthan (hereinafter 'University') Ordinances which require minimum 45% marks to be admitted in the three year LLB course.

Counsel for the petitioner submitted that in the case of [RLW 2006(2)Raj1054] Rajul Arora Vs. Jai Narain Vyas University and Anr. it has been held that a student who obtained over 44.50% marks in the three year Bachelor Degree examination was entitled to have the marks rounded off to 45% rendering him eligible for consideration for admission into the three year LLB course in the University. He submitted that the (2 of 2) [CW-9723/2017] issue agitated in the petition is wholly covered by the aforesaid judgment of this court and the writ petition therefore be accordingly disposed of, directing the respondent-University to treat the petitioner eligible to be considered for admission to its three year LLB course.

Mr. Rachit Sharma appearing for the respondent-University is not in a position to satisfy this Court that the judgment of this Court in the case of Rajul Arora (supra) has been set aside or any contra view elsewhere taken by this Court.

Resultantly the petitioner has been able to make out an iron clad case on parity.

The petition is accordingly allowed. It is held that the petitioner having secured 44.72% marks in his three year Bachelor Degree examination is entitled to have the marks rounded off to 45% rendering him eligible for consideration for admission into the three year LLB course in the University. It is made clear that this order only addresses the petitioner's minimum eligibility. He would be only entitled to admission as per his comparative merit and the vacancies into the three year LLB course of the University.
