                                 This application coming on for admission this day, the court passed the
                           following:
                                                                ORDER

This is first bail application filed under Section 439 CrPC on behalf of applicant in connection with Crime No.212/2022, registered at Police Station Dehat, Tikamgarh, District Tikamgarh (M.P.), for the offences punishable under Sections 353, 332, 333, 294, 323 and 506 of IPC.

Learned counsel appearing for the applicant submitted that investigation is complete and charge sheet has already been filed. It is submitted that applicant was not armed and as per the allegations, he assaulted with hands and fist. In these circumstances, applicant be released on bail.

Learned Govt. Advocate appearing for the respondent/State opposed the prayer for grant of bail. It is submitted that offence under sections 333 of IPC is punishable with 10 years sentence. Offence committed by applicant is serious in nature and victim has also suffered hairline fracture of ribs. Victim was Secretary. Applicant is also having criminal antecedent.

Considering the aforesaid facts and circumstances of the case, bail application filed by the applicant is dismissed.

Applicant is at liberty to file repeat bail application after period of three months.
