BY HONBLE MRS.SHYAMA DOGRA, JM Heard the learned counsel for the parties.
2. After perusal of the pleadings and the decision rendered by this Tribunal in T.A.NO.35/PB/2009) in the case of Raj Kumar & Another versus Union of India & Ors. ( Annexure P-9) decided on 22.1.2010 along with other connected matter, this case is found to be squarely covered by the aforesaid decision. Therefore, this O.A stands disposed of in the same terms and the directions given in the aforesaid matter to the following effect.
3. Consequently, the respondents are directed to restore the benefit of GPF Scheme to the applicants as per Rules applicable in their case on receipt of copy of this order. Needless to say that since the respondents have preferred an SLP against the order dated 22.1.2010, the directions given by this Tribunal would be subject to the decision of the SLP.
4. In terms of the above directions, this O.A stands disposed of with no order as to costs.
