In Re: CAN 11578 of 2017 This is an application for substitution after setting aside abatement. The respondent no.7 breathed his last on September 22, 2017.
Having heard the learned Advocate appearing on behalf of the respective parties as also after considering the facts and circumstances involved in this case, I am of the opinion that the names of the following applicants should be substituted in place of the respondent no.7: 2
"(1) Krishna Saha, wife of the deceased respondent no.7.
(2) Babai Saha, son of the deceased respondent no.7."
This court is satisfied with the explanation given for allowing the prayer for setting aside abatement.
The application stands allowed granting leave to the applicants for substituting their names in place of the respondent no.7.
This application being CAN 11578 of 2017 stands disposed of.
There will be, however, no order as to costs. In Re: W.P. No. 14748 (W) of 2017 Let the writ petition being W.P. No. 14748 (W) of 2017 appear in the Monthly Combined List of February, 2018 under the same heading.
