Learned counsel for respondent No.1 states that respondent No.1-Sharafat Ali was already in possession of the suit property. The sale deed has already been executed and registered with the process of the Court. Mutation has also been sanctioned in favour of respondent No.1. The execution stands satisfied and no execution proceedings are pending.
Learned counsel further states that this revision peition has become infructuous.
Since, there is no representation on behalf of the petitioner to controvert the aforesaid fact, therefore, I deem it 1 of 2 ::: Downloaded on - 23-12-2019 01:32:52 ::: CR No. 8072 of 2017 (O&M) -2- appropriate to dispose of this revision petition as infructuous with a liberty to the petitioner that in case statement of fact made by learned counsel for respondent No.1 is found to be incorrect, the petitioner may move an application for restoration of this revision petition.
