Date : 18.09.2023 Case taken up before the Lawazima Court.
None appears on behalf of the petitioner.
Perused the records.
The office note dated 16.09.2023 reveals that notice was issued to the respondent Nos. 4 to 10 by registered post with A/D on 22.05.2023.
And, it appears that the A/D cards in respect of all the respondent except respondent No. 6 have been received back. A perusal of the A/D cards reveals that the said A/D cards bear purported signature of the respondents. In addition to the aforesaid, it appears that the respondent No. 9 has filed an Affidavit-in-opposition. In the said affidavit, the respondent No. 9 has inter alia acknowledged the receipt of the notice.
As such, service upon the respondent Nos. 4, 5, 7, 8, 9 & 10 has been completed.
Further, in respect of the respondent No. 6, it appears that neither the A/D card nor the un-served notice has been received back. However, the track consignment report available with the case record reveals that notice in respect of the respondent No. 6 has been delivered to the addressee on 24.05.2023. As such, service upon the respondent No. 6 has been completed.
As mention has been allowed in the instant matter for listing on 19.09.2023, the matter is laid before the hon'ble Court.
