PER: R.C. SHARMA, A.M. This is an appeal filed by the assessee against the order of ld.CIT(A)-I, Jaipur dated 31/12/2018 for the A.Y. 2007-08 in the matter imposition of penalty U/s 271(1)(b) of the Income Tax Act, 1961 (in short the Act).

2. It was submitted by the ld AR of the assessee that the assessee was not in receipt of notice issued by the Assessing Officer for appearance. It was explained that due to medical reasons, the assessee could not appear 2 ITA 49/JP/2019 Subhash Chand Ajmera Vs. ITO before the Assessing Officer. In support of the same, the assessee has filed affidavit as well as medical certificate. Considering the reasonable cause for non-appearance, I do not find any merit in the penalty so imposed U/s 271(1)(b) of the Act amounting to Rs. 10,000/-, therefore, the Assessing Officer is directed to delete the same. I order accordingly.

3. In the result, appeal of the assessee is allowed.
