33. Relaxation of Rules.
- (A) Relaxation of Rules by the Governor. - Notwithstanding anything contained in these rules, the Governor of the State may relax the application of the rules in relation to any member of the service or any person to be appointed to the service.Provided that where any such rule is applicable to the case of any person, the case shall not be dealt with in a manner less favourable to him/her than that provided by the rules.(B)Relaxation of rules by the High Court. - Without prejudice to the power of the Governor under Rule 33-A, the High Court shall also have the power to relax any of the rules and deal with the case of a member of the service holding a post carrying a scale of pay less than that of a Junior Assistant or any person to be appointed to such post insofar as such case relates to the service conditions governed by these rules in such manner as may appear to it to be just and equitable.Provided that where any such rule is applicable to the case of any member, the case shall not be dealt with in any manner less favourable than that provided by that rule.
