In the instant petition, petitioner has questioned the validity of letter dated 22.3.2017 (Annexure P-11) by which the petitioner's grievance relating to extension of service on contract basis to the post of Scientist B at Patent Information Centre has been declined.
The respondents have advertised the post of Scientist B for the purpose of selection and appointment on contract basis in order to run Patent Information Centre. The petitioner was a candidate and she was selected and appointed on contract basis for a period of one year. Thereafter it was extended. The respondents have informed that the petitioner would not be continued beyond 30.3.2017. Therefore, she had submitted an application for extension of contract to the post of Scientist B. The same has been declined by the respondents. The petitioner being a contract appointee has no right to claim over the post of Scientist B. Further she is not entitled for regularization to the post of Scientist B for the reasons that her appointment is only on contract basis for a period of one year. If the petitioner is asking for continuation and regularization, it amounts to violation of Articles 14 and 16 of the Constitution for not giving opportunity to other eligible candidates to participate in the process of 1 of 2 ::: Downloaded on - 08-04-2017 06:17:25 ::: CWP No.6317 of 2017 -2- selection to the post of Scientist B in the Patent Information Centre on regular basis. Thus, the petitioner has not made out a case so as to interfere with the letter dated 22.3.2017 (Annexure P-11).
Accordingly, petition stands dismissed.
