Writ Petition No.188/2016
(Anshuman Singh Tomar Vs. State of M.P. & Others)
11/01/2016
Shri Prashant Sharma, Advocate for the petitioner.
Shri S.K. Jain, Government Advocate for the
respondents/State.
This writ petition under Article 226 of the Constitution of India is filed seeking command to respondents to expeditiously complete the investigation on the FIR lodged against the petitioner. Admittedly, the FIR has been lodged on 30/08/2015 in Police Station Myana, District Guna as regards Crime No.286/2015 for the offence punishable under Section 302 of IPC. Only four months period have so far passed by. Petitioner claims to have filed a representation Annexure P/5 address to Chief Secretary and Home Minister for the aforesaid prayer. It is a peculiar petition where on the one hand, not a single document is placed on record, where by the petitioner has approached the concerning Police Station for the purpose of seeking indulgence with assurance of full cooperation for expeditious investigation, on the other hand, he has filed a representation to the Chief Secretary and Home Minister, who have nothing to do with the investigation. Now the petitioner has flocked to this Court with the relief in the form of command to respondent to expedite the investigation. The conduct of the petitioner itself shows that he is trying to run away from the investigation and seek intervention of this Court for collateral purpose. Such course of action lacking bonafide cannot be countenance. Hence, this writ petition is found to be misconceived accordingly, dismissed.
