O R D E R
05/ 08-09-2008The batch of cases are also concerning the grievance of the petitioners with regard to non-payment and/or part payment of GPF amount. Earlier other batch of 7 cases have been disposed of by order dated 29-8-2008 with certain directions.
In some cases, learned counsel for the respondents have raised a grievance that in spite of request for necessary informations/documents from the Head of the Departments or Controlling Officers of the concerned employees, the informations/documents have not been supplied to the concerned District Provident Fund Officer for processing the claims in respect of the employees concerned.
Therefore, this batch of writ applications are also disposed of in terms of the order dated 29-08-2008 passed in CWJC No.2525 of 2003 and other analogous cases with a further direction to the concerned Head of the Departments, Controlling Officers of the concerned retired/deceased employees to supply necessary informations/documents sought for by the concerned District Provident Fund Officer within a period of four weeks from the date of receipt of such requisition.
In case the concerned Head of the Department or the Controlling Officer does 8 not take steps to supply all necessary informations/documents to the concerned District Provident Fund Officer in this regard, he shall be personally held liable for delay caused by him in processing the claim of the concerned employees by the concerned District Provident Fund Officer and he shall be liable to pay interest from his own pocket for the period of delay caused by him at the rate of 18 percent quarterly compoundable.
