04. 1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner is an accused in connection with C.T. Case No.359 of 2022, pending before the Court of the learned J.M.F.C., Junagarh arising out of Junagarh P.S. Case No.370 of 2022 for alleged commission of offences under Sections 302/201/34 of IPC.

3. Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Dharamgarh, Dist-Kalahandi, by order dated 09.01.2022 in the aforementioned case, the present BLAPL has been filed.

4. It is submitted that petitioner is in custody since 03.09.2022 and as charge sheet has been filed in the meanwhile and taking into account the nature of allegation, the petitioner may be released on bail.

5. Learned counsel for the State places the statements of Debendra -CSW No.5 and Rudra Prasad Nayak-CSW No.33.

6. Taking note of such statement and considering the manner in which the deceased was brutally assaulted even after he fell on the ground, this Court is not inclined to entertain this bail application at this stage.

7. Accordingly, the BLAPL stands disposed of giving liberty to the petitioner to renew his prayer before the learned Court in seisin at a later stage.
