The writ petitioner is holder of an existing stage carriage permit outside Kolkata, between Barrackpur Court and Kanchrapara in the district of North 24- Parganas. The vehicle which was plying against his permit had to be replaced as its age had crossed 30 years and the petitioner seeks time till 10th October, 2011 to introduce a new vehicle compatible with the emission norms stipulated under the law. If the petitioner makes an application in this regard, the concerned authority shall extend the time for placing a new vehicle against the said permit till 10th October, 2011. If the petitioner applies for renewal of his permit, the same shall be considered and decided upon in accordance with law.

The writ petition stands disposed of in the above 2 terms.

Since this writ petition is being disposed of without calling for any affidavit, the allegations made in the writ petition shall be deemed to have not been admitted.

There shall, however be, no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the learned Counsel for the parties, as expeditiously as possible.
