It is brought out that Deputy Commissioner Panipat ordered suspension of the petitioner from the post of Sarpanch and also directed regular enquiry to be conducted. Order was challenged by the petitioner in appeal. Financial Commissioner and Principal Secretary to Govt. of Haryana, Development and Panchayats Department allowed the appeal in regard to suspension of the petitioner. Order of the Deputy Commissioner in that regard having been set aside, the petitioner was reinstated.

Learned counsel for the petitioner contends that effect of the order passed by the appellate authority would be that even regular enquiry cannot be conducted.

I am not convinced with the argument. Order passed in appeal dated 28.02.2006 Annexure P-7 is explicit that it confines itself to suspension part of the order.

Learned counsel for the petitioner prays for withdrawal of the petition to enable him to file a better petition with complete particulars alongwith the regular enquiry report.

Dismissed as withdrawn with liberty as prayed for.
