UPON hearing the counsel the Court made the following
O R D E R
I.A. NO. 53637 OF 2022:
A proposal was made by the State of Maharashtra to the Union of India under the Child Protection Services (CPS) Scheme seeking approval to open 26 NGOs run by shelters, detailed hereinafter:
04 in Bruhan Mumbai Municipal Corporation, 01 in Mira Bhayandar Corporation, 01 in Ulhasnagar, 03 in Pune, 01 in Pimpri Chinchwad, 02 in Solapur, 01 in Sangli 5 Miraj, 01 in Malegaon, 01 in Jalgaon, 02 in Aurangabad, 02 in Nanded, 02 in Latur, 02 in Parbhani, 01 in Nagpur, 01 in Akola and 01 in Chandrapur.
Identification of Children in Street Situations (CiSS) is being monitored by this Court and directions have been issued periodically to all the State Governments for their rehabilitation of CiSS. According to the data provided by NCPCR, about 5000 CiSS have been identified in the State of Maharashtra. The State intends to start Open shelters to provide community-based facilities to CiSS in need of shelter, on short term basis.
In response to the application filed by the State of Maharashtra, the Union of India has filed an affidavit bringing to the notice of this Court that the budgetary allocation for the CPS Scheme has been increased from Rs. 900 crore for the financial year 2021-2022 to Rs. 1472.17 crore for the financial year 2022-2023. The State of Maharashtra is permitted to submit a proposal for starting 20 open shelters for the financial year 2022-2023 within a period of one week from today. Union of India shall take a decision and grant its approval within a period of two months from the date of receipt of the application. In addition to the request for approval under the CPS scheme, the State of Maharashtra shall 6 also make an application to the Ministry of Social Justice and Empowerment for approval for starting the open shelters.
