This order will dispose of both the afore-mentioned petitions for regular bail filed under Section 439 of Code of Criminal Procedure in FIR No.56 dated 2.5.2011 under Sections 306, 304-B, 498-A read with Section 120B of Indian Penal Code, registered at Police Station Nangal, CRM No.M-29423 of 2011 -2- District Rupnagar (Ropar).
I have heard learned counsel for the parties and gone through the record.
It has been argued by the learned counsel for the petitioners that they are old parents-in-law of deceased and that they used to live separate from deceased and her husband and were having no concern with the matrimonial life of deceased and her husband. It has also been contended that even as per FIR, there is no allegation of demand of dowry so far as the present petitioners are concerned. It has also been contended that death has also taken place after about six years of the marriage. Further contends that petitioner Dalel Singh has been continuing in custody since 6.5.2011 and petitioner Balwinder Kaur has been continuing in custody since 18.11.2011 and trial is not likely to be concluded in near future as only three witnesses have been examined so far.
Learned counsel for the State on the instructions of Head Constable Ashraf Khan, has not disputed these facts.
There are no allegations on behalf of the State that petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.
Hence, keeping in view these facts and without expressing any opinion on merits, both the afore-mentioned applications for regular bail filed on behalf of petitioners Dalel Singh and Balwinder Kaur are allowed.
Bail to the satisfaction of CJM/Duty Magistrate, Rupnagar (Ropar).
