2. Learned counsel for the petitioners submits that petitioner no.1, Ranjeet Kumar and petitioner no. 7, Ajit Kumar Mandal are in Extremely Backward Class (EBC). Petitioner no. 2, Sanjay Kumar Das, petitioner no.4, Kailash Das, petition no.5, Sachida Nand Das, petitioner no.6, Amit Kumar and petitioner no.9, Manoj Kumar are in Scheduled Caste (SC) category and petitioner no.3, Makuni Kumar and petitioner no. 8, Sanjoy Kumar Roy are of Backward Class (BC) category. The petitioners along with others had applied for empanelment of their names for the purpose of selection to the post of Class-IV employees and thereafter, panel list was prepared for respective category, separately (annexure 2 series) but in the panel list, the name of the petitioners were shown below to the candidates who are junior in age to the petitioners in their categories and in the final panel list (annexure 3 series), the names of the petitioners do not find in the list while the name of other candidates, who are junior in age to the petitioners are shown in their respective categories. Further submission is that petitioners have filed the representation in this regard before the District Magistrate, Bhagalpur, but the same is still pending for disposal since July, 2019.

In view of the submission of the learned counsel for the petitioners, the writ petition is disposed of with a direction to Patna High Court CWJC No.21370 of 2019 dt.02-12-2019 3/3 the petitioners to file the fresh representation before the District Magistrate, Bhagalpur, within three weeks from today and the District Magistrate, Bhagalpur, shall consider the same and pass appropriate order in accordance with law within a period of eight weeks thereafter.

4. Accordingly, this writ petition stands disposed of.
