Title: Shri Yogi Aditya Nath (MP) raised a question of Privilege against Inspector General of Police, Gorakhpur and District Administration, Gorakhpur for having infringed his privilege. The Speaker made observation in this regard.
MR. SPEAKER: Hon. Members, I would just make one observation.
I have always been repeating and requesting that there is no question of any denial of an important issue to be raised. But there are certain procedures which have to be followed on certain occasions. We have decided in the Committee with the leader of Parties. I have announced it that there would be no Luncheon Hour and no other matter because of the important matter – General debate on the General Budget. But in spite of that, I have agreed to allow Yogi Aditya Nath ji because of some issue which he feels strongly to be raised.
The hon. Member Shri Kuppusami met me this morning. I said that I would allow it tomorrow. He accepted it. But I did not even know that that is the matter that is being raised. He accepted that position. Therefore, I will call you tomorrow – if you are agreeable to it – as the first thing after the Question Hour, after the Papers are laid. Please cooperate. Your issue can be properly raised.[R16] Then you will have the satisfaction of doing duty to the people.
Now, Yogi Aditya Nath will make his submission. Today, no other matter will be allowed to be raised except the matter relating to Yogi Aditya Nath, because it is a matter of privilege.

योगी आदित्यनाथ :अध्यक्ष महोदय, मैं तीसरी बार लोक सभा का सदस्य बना हूं। पहली बार मैं २५ हजार मतों से जीता था, दूसरी बार ५० हजार मतों से और तीसरी बार लगभग १.५० लाख मतों से गोरखपुर से चुनकर के आया हूं। लेकिन पिछले कुछ समय से राजनीतिक विद्वेष के तहत मुझे राजनीतिक पूर्वाग्रह का शिकार बनाया जा रहा है। मैं केवल आपसे यह अनुरोध करने आया हूं कि क्या मैं इस सदन का सदस्य हूं या नहीं? क्या यह सदन मुझे संरक्षण दे पाएगा या नहीं?...( व्यवधान)

योगी आदित्यनाथ :अध्यक्ष महोदय, यह सदन मुझे संरक्षण नहीं दे सकता है तो मैं आज ही इस सदन को छोड़कर के वापस जाना चाहता हूं। मेरे लिए यह सब कोई महत्व नहीं रखता है। मैंने अपने जीवन से समाज के लिए सन्यास लिया है, मैंने अपने मां-बाप को छोड़ा है, लेकिन आज मुझे राजनीतिक पूर्वाग्रह के तहत अपराधी बनाया जा रहा है क्योंकि मैंने वहां भ्रष्टाचार के मामले उजागर किए थे, भारत-नेपाल सीमा पर आईएसआई और राष्ट्रविरोधी गतवधियों के खिलाफ आवाज़ उठाई थी और बराबर सदन का ध्यान इस ओर आकर्षित करता रहा। मैं वहां भुखमरी से हो रही मौतों के खिलाफ प्रशासनिक भ्रष्टाचार का मामला उठाता रहा, इसलिए मेरे खिलाफ सारे मामले बनाए गए हैं और बनाए जा रहे हैं।
महोदय, मुझे २८ तारीख को जेल में निरूद्ध किया गया। जिसकी सूचना इस सदन को गोरखपुर जिला प्रशासन ने जो दी है, वह भी मैं आपको बताना चाहता हूं। उन्होंने लिखा है कि “श्री योगी आदित्यनाथ, लोक सभा सदस्य को शांति भंग होने की आशंका में २८ जनवरी २००७ को दोपहर बाद सदर क्षेत्र गोरखपुर उत्तर प्रदेश में गिरफ्तार किया जाता है।” महोदय, मुझे शांति भंग होने की आशंका के तहत गोरखपुर से २० किलोमीटर पहले गिरफ्तार किया जाता है तो शांति भंग होने की आशंका से १०७, ११६ के तहत कोई भी प्रशासन किसी भी व्यक्ति को २४ घण्टे से अधिक अभियुक्त बनाकर नहीं रख सकता। लेकिन मुझे ११ दिनों तक गोरखपुर जेल में क्यों रखा गया?

योगी आदित्यनाथ :यही नहीं जब इस मामले में मेरे अधिवक्ता ने प्रशासन से जानने का प्रयास किया कि आखिर किस मामले में मुझे बंद किया है तो पहले कहा गया कि शांति भंग की आशंका में[r17] , जब पहली फरवरी को मेरे अधिवक्ता ने इस मामले में गोरखपुर डिस्टि्रक्ट जज के यहां एक निगरानी अपील दायर की तो बैक डेट पर मेरे खिलाफ तमाम मामले दर्ज कर दिये गये और मामले दर्ज करने के बाद मुझे पुन:...( व्यवधान) महोदय, कोई भी एफ.आई.आर. होती है तो २४ घंटे के अन्दर न्यायालय में उसकी नकल भेजी जाती है, लेकिन मेरे मामले में सात दिनों तक कोई भी एफ.आई.आर. की प्रति न्यायालय में नहीं भेजी गई। यह साबित करता है कि मेरे खिलाफ बाद में बैक डेट में मामले दर्ज किये गये और उसके बाद...( व्यवधान)

योगी आदित्यनाथ :परसोंउस मामले की पुनर्विवेचना का आदेश देकर मेरे खिलाफ ३०२ और ३०७ में पुन: मुझे अभियुक्त बनाने का षडयंत्र उत्तर प्रदेश सरकार कर रही है। मैं अधिकारियों के बयान आपके सामने उद्धृत करना चाहता हूं, जो उन्होंने मेरे खिलाफ दिये हैं और उन्होंने किस रूप में संसद को भी गुमराह करने का प्रयास किया है, वह बताना चाहता हूं, मेरे खिलाफ जो उन्होंने किया है।[R18] उस बारे में गोरखपुर के जिस जिलाधिकारी ने मुझे गिरफ्तार किया, मेरी गिरफ्तारी के बाद जब जनता का आक्रोश फूटा तब वह व्यक्ति निलंबित हुआ। उसके बाद उस व्यक्ति का * Not recorded बयान आता है कि अब समाजवादी पार्टी को मुसलमान लोग वोट नहीं देंगे यानी अधिकारी तय करेगा। अब अधिकारी तय करने लग गए हैं कि कौन, किसको वोट दे रहा है। उन्होंने आउटलुक मैगज़ीन में यह बयान दिया है। इसके अलावा और अधिकारियों ने जो बयान दिए हैं, मैं उन्हें देखना चाहता हूं। गोरखपुर जोन के तत्कालीन आईजी ने पूछा कि योगी जी को क्यों जेल भेजा गया। जिस दिन मुझे गिरफ्तार किया गया, उस दिन मैं गोरखपुर की समस्याओं को लेकर गोरखपुर के जनप्रतनधियों, व्यापारिक संगठनों के नेताओं और अन्य तमाम पदाधिकारियों के साथ एडीजीपी, लॉ एंड आर्डर, उत्तर प्रदेश से मिलने गोरखपुर सर्किट हाउस गया था।...( व्यवधान)

So far as your matter is concerned, I am again repeating that you are an hon. Member of his august House. I respect you for your commitments. There is no question about your commitments. But as you know, some procedure has to be followed. I can assure you that if in any way, your privileges have been interfered with, whatever power is there in this House and in the Chair, will be used irrespective of anything else. Please rest assure, I will try to do my best, but I have to proceed according to procedures and norms.
