1. During the course of hearing, we pointed out to Mr. Aditya Narayan Tripathy, learned Counsel for the petitioner, that the ACR of 2006-2007, which was adverse to his client, was never challenged and that, therefore, the decision of the respondents in the review DPC held on 4 November 2010, not to promote the petitioner, could not be faulted with.
2. He acknowledges that there was a lapse on the part of his client in failing to challenge the ACR of 2006-2007. However, given the fact that 15 years have passed since then, Mr. Tripathy fairly seeks on instructions to withdraw the writ petition.
