This application under Article 227 of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Judge, 3rd Bench, Presidency Small Causes Court, Calcutta to dispose of the Ejectment Execution Case No. 156 of 2013 arising out of Ejectment Suit No. 12 of 2007 expeditiously.
Learned advocate for the petitioner submits that the execution case is pending from the year 2013 and a direction should be passed upon the learned Executing Court to dispose of the same expeditiously.
In view of the order sought and proposed to be passed, there is no necessity to direct issuance of a notice upon the opposite party. However, the learned Advocate on Record of the petitioner shall be obliged to forward a copy of this application upon the opposite party or upon the learned advocate representing the opposite parties before the Executing Court. 2 From the order sheet appended to the civil revisional application, it appears that a Misc. Case No. 75 of 2024 is pending and 7th March, 2025 was fixed for awaiting order of the said misc. case and for further order.
CO 987 of 2025 is disposed of with the hope and trust that the learned Judge, 3rd Bench, Presidency Small Causes Court, Calcutta shall make an endeavor to see that the pending miscellaneous cases are disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the pending miscellaneous cases, the learned Executing Court shall make an endeavor to dispose of the Ejectment Suit No. 156 of 2013 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
