                                       ORDER

Shri Rakesh Kumar, hereinafter called the appellant has filed the present appeal dated 23.8.2011 before the Commission against the respondent Delhi Police, Licensing Unit for not providing satisfactory and complete information of his RTI-application dated 19.5.2011. The matter came up for hearing on 21.03.2012. The appellant was present and the respondent were represented by Shri Rajneesh Garg, ACP and Shri Rajesh, ASI.

2. The appellant had filed an application dated 19.5.2011 under the RTI Act seeking information on thirteen queries pertaining to fire-crackers licence. The CPIO vide his letter dated 22.6.2011 provided requisite point-wise information in respect of Point No. 1 to 12 to the appellant; on Point No. 13 the appellant was provided an opportunity for inspection of the relevant records/files.

3. However, not satisfied with the reply of the CPIO, the appellant filed first- appeal on 19.4.2011 before the FAA. The FAA vide his order dated 5.4.2011 upheld the reply of the CPIO. Thereafter the appellant has filed the present appeal before the Commission.

During the hearing the respondent submits that briefly the issue is that the Delhi Police, Licensing Unit has specified a requirement of 6 meters road-width for sanction of temporary fire-crackers licence and a requirement of 12 meters road-width for a permanent fire-cracker licence. The appellant wishes to know the reasons behind such a decision. The contention of the appellant is that as per the building bye-laws of DDA, the requirement for the road width is 6 meters and 9 meters for turning the fire tenders. He, therefore, wishes to know the reasons as to why there is requirement of 12 meters road-width for obtaining permanent fire-crackers licence.

Having considered the submissions of the parties the CPIO is hereby directed to provide relevant information including reasons why there is a requirement of 12 meters road-width for obtaining permanent fire-crackers licence, to the appellant, within two weeks of receipt of this order The matter is disposed of with the above directions.
