Section 94 in The United Provinces Tenancy Act, 1939

94. Suit for determination and for arrears of rent

. - (1) When no rent has been fixed and any person has been admitted to the occupation of land, or permitted to retain possession of land by any one having a right to admit or permit him with the intention that a contract of tenancy should thereby be effected, or becomes a hereditary tenant under the provisions of this Act, either he or the person entitled to admit or permit him may, at any time during the period of occupation or within three years after the expiry of such period, due to have rent fixed thereon, and, subject to the law of limitation as to arrears of rent, for a decree for arrears of such rent.
(2)In a suit under sub-section (1), the rent decreed shall be the rent payable in the year previous to the year of admission, permission, or accrual of hereditary rights, as the case may be, or if no rent was payable in such year, the rent shall be fixed in accordance with the provisions of this Chapter.
