The O.A having been heard on 23 rd November, 2021, this Tribunal delivered
the following order on the same day:
O R D E R (ORAL)
P.Madhavan, Judicial Member This Original Application has been filed by the applicants praying for the following reliefs:
"i) call the records pertaining to Annexure A2 promotion order issued to the unserved candidates and two ST candidates leaving 34 SC reserved vacancies.
ii) Direct the respondent to report the reason for the non filing up of SC backlog vacancies even though the SC backlog vacancies were available prior to the occurrence of the unserved vacancies.
iii) Direct the respondents to consider Annexure A3 representation and similar representations submitted by the applicants and promote the applicants against the unfiled reserved vacancies, with effect from the date the unserved candidates were promoted, with consequential pay fixation and arrears.5
iv) Issue such other order/orders as this Hon'ble Tribunal may deem fit and proper and thus render justice.
2. Brief facts of the case are as follows:
Applicants were selected by Railway Recruitment Board, Trivandrum for the post of Assistant Loco Pilot and appointed on various dates into Trivandrum Division after successful completion of training. The applicants belong to communities of SC category and eligible for promotion to the next higher grade against the shortfall and back-log reserved SC vacancies after completion of 2 years in the post of Senior Assistant Loco Pilot under usual terms and conditions as per the establishment rules and provisions of Establishment Manual. Applicants submit that even though there are numerous reserved shortfall/back-log vacancies of SC category from 2018 onwards, the 3 rd and 4th respondents had not filled those reserved vacancies. The applicants gave representations to the 4 th respondent on various dates during 2019 but the 4th respondent had not taken appropriate action to fill up the shortfall/backlog SC reserved vacancies with the applicants. Hence the applicants have approached this Tribunal praying for the aforementioned reliefs.
3. When the matter was taken up for admission hearing, Adv.Mr.Sunil Jacob Jose takes notice on behalf of the respondents and submits that the representations pending are of the year 2019.
4. Counsel for the applicants submits that the applicants may be allowed to give a detailed fresh representation and the applicants will be satisfied if the said representations are considered and disposed of within a time frame in the light of relevant rules and regulations on the subject.

In view of the limited submission, the first applicant is directed to file a fresh detailed and composite representation regarding the grievances made in the O.A to the Competent Authority within a period of two weeks from the date of receipt of a copy of this order and the Competent Authority will consider and pass a speaking order on the new representation given by the first applicant as well as earlier representations given by other applicants within a period of three months from the date of receipt of such representation filed by the first applicant.
6. Without going into the merits of this matter, the Original Application is disposed of as above at the admission stage itself. No costs.
