: Heard learned counsel for the parties.

The petitioner is an accused in a case registered under Sections 147, 148, 149, 323, 325, 307, 337, 338, 353, 332, 333, 427 and 120B of the Indian Penal Code and Sections 3/4 of Prevention of Damage to Public Property Act.

It reveals from the first information that a mob of about 400 to 500 persons created mischief and also used force against the police party, in view of the fact that dead bodies of four children had been recovered from a pond. The petitioner is also named in the first information report.

It is submitted that co-accused-Jitendra Mahato @ Disco Mahto having similar allegation has been granted anticipatory bail by this Court vide A.B.A. No.42 of 2015.

Counsel for the State has opposed the petitioner's prayer for anticipatory bail.

Since co-accused Jitendra Mahato @ Disco Mahto having similar allegation is enjoying the privilege of anticipatory bail, the petitioner, above named, is also directed to surrender before the court below within two weeks from today and, if he does so, he shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of like amount, each, to the satisfaction of the learned Judicial Magistrate, Dhanbad in connection with Jogta P.S. Case No.10 of 2013, corresponding to G.R.No.234 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
