UPON hearing the counsel the Court made the following
O R D E R
1. It is noticed that the impugned order of the High Court is on consent of the parties to the effect that their case is covered by the order dated 12.01.2022 passed in D.B. SAW No.534/2005 titled as State of Rajasthan & Ors. vs. Firdos Tarannum & Another.
2. On this, the learned counsel for the petitioner however submits that the respondent in the present case is not an Urdu Teacher and therefore the decision in Firdos Tarannum may not apply.
3. On the other hand, Mr. Arunava Mukherjee, learned counsel appearing for some of the related parties submit that in Firdos Tarannum where the State had filed appeal, this Court had issued notice limited to the question on whether other benefits of appointment with retrospective effect can also be granted to the concerned respondent. 2 However, notice was declined on the first issue whereby the petitioners were directed to consider the case of the respondent for appointment.
4. We have noted the above. But acceding to the prayer of the petitioner’s counsel, three weeks time is granted for filing additional documents.
5. List after three weeks.
