The matter is taken up for hearing through video conference due to COVID-19 situation.
This second petition under Section 439 Cr.P.C. is filed seeking regular bail in case of FIR No.120 dated 24.12.2020, under Sections 3-A, 3-B, 5-6, 23, 25 Rule 3A(1) PC and PNDT Act, 1994, and Sections 420/120-B IPC, 1860 (Section 15(2) of IMC Act, 1956 was added lateron), registered at Police Station Daba, District Ludhiana.
Earlier petition was dismissed on merits on 28.1.2021. Learned counsel for the petitioner submits that there is change in circumstance and certain new facts have emerged after filing of the challan.
Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach the Court concerned to point out change in circumstance.
Dismissed as withdrawn with liberty as prayed for.
