COMMON JUDGMENT:(per Hon'ble Sri Justice T.Vinod Kumar) Since the grounds raised in these appeals are one and the same, the appeals are being taken up for hearing together and disposed of by this common judgment.
2. The appellant(s) in all these appeals contend that though they are arrayed as 4th respondent in the subject writ petitions, no notice has been issued by the learned Single Judge before passing the impugned orders in the said writ petitions.
3. Learned counsel for the appellant(s) contends that the least the Court could have done before passing the impugned order is to issue notice to the appellant(s) herein who are arrayed as respondents in the Writ Petitions before adjudicating the writ petitions inasmuch as the same affects their rights and thus there has been violation of principles of natural justice.
4. We have taken note of the said submissions and perused the impugned orders of the learned Single Judge. 2
5. In the impugned order passed in WP.No.8901 of 2023, the learned Single Judge while dealing with the above said contention of the appellant(s), at para 6 (though typed as 7) of the impugned order has recorded as under:
"6. In view of the above submissions, this Writ Petition is disposed of directing respondents 2 and 3 to consider the said objections dated 06.03.2023 submitted by the petitioner and also online application dated 10.12.2022 submitted by respondent No.4, pass appropriate orders in compliance with the said order dt.23.01.2023 in WP.No.1651 of 2023 by putting the petitioner and respondent No.4 on notice and affording them an opportunity of hearing."
6. Similar observation was made in the impugned orders passed in all the other Writ Petitions.
7. In view of the categorical finding recorded by the learned Single Judge assigning reasons for not issuing notice to the appellant(s) herein, though are arrayed as respondents in the Writ Petitions, and having only directed the authorities to dispose of the representations stated to have been submitted by the writ petitioners as well as the appellant(s) herein, who had also approached this Court on earlier occasion by filing Writ Petitions, after putting the petitioner and unofficial respondent on notice and affording them an opportunity of hearing, the said 3 direction in our considered view would cause no prejudice to the appellant(s) herein since it is always open for the appellant(s) herein to take all the pleas available to them in law before the concerned authority including the plea of lack of jurisdiction of the said authority to adjudicate the said claims.
8. In view of the above, we see no infirmity in the order of the learned Single Judge for being interfered in these appeals.
9. Accordingly, all these appeals are dismissed. No order as to costs.
10. Consequently, miscellaneous petitions pending, if any, shall stand closed.
