Section 38 in Indian Merchant Shipping (Seamen's Employment Office, Calcutta) Rules, 1954
38. When a shipowner requires a substitute in the place of a seaman who was previously recruited through the Employment Office and whose services are within 24 hours before the ship is due to sail, lost by death, desertion or other unforeseen cause, the recruitment shall, where practicable be made through the Employment Office but when not practicable the shipowner may recruit a person of his choice but he shall as soon as possible furnish to the Director of the Employment Office full particulars of the substitute so recruited.
