Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 386 and 427 of the Indian Penal Code.

The prosecution case is that the informant along with other persons were going to attend a political rally when they were intercepted by mob of 18 FIR named and 80-90 unknown and they robbed the gold chain, cash of rupees fifty thousand and other articles.

It is submitted by learned counsel for the petitioners that the mob was protesting against the crushing of a child by unidentified Scorpio vehicle, hence, in retaliation to that the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal Patna High Court Cr.Misc. No.4762 of 2016 (2) dt.04-02-2016 3/3 antecedent.

Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 2nd, Saran at Chapra in connection with Marhaurah P.S. Case No. 401 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
