1. Petitioner has filed this bail application under Section 439 of Cr.P.C.

2. F.I.R. No. 249/2020 was registered at Police Station Chauth Ka Barwada, District Sawai Madhopur, for offences under Sections 498-A, 304-B and 201 of IPC.

3. It is contended by counsel for the petitioner that the deceased committed suicide by jumping into a dry well. She was rushed to the Government hospital from where she was referred to Jaipur hospital, but on the way she expired and her funeral was done early in the morning. It is also contended that information was given to the family members of the deceased and family members arrived after the cremation.

(2 of 2) [CRLMB-9175/2021] It is contended that there is specific allegation of demand of dowry. Deceased was not taken for post-mortem and funeral was done before the family members arrived, which points towards the guilt of the petitioner who happens to be husband of the deceased.

5. I have considered the contentions.

6. Considering the contentions put forth by learned Public Prosecutor, I am not inclined to grant bail to the petitioner.

7. Criminal Misc. Bail Application is accordingly, rejected.

8. However, petitioner would be free to move fresh bail application after recording of the statement of material witnesses.
